About these terms

ClearScale Marketing Limited, registered in England and Wales under company number 15407195. Registered office: 22 Derby Street West, Ormskirk, Lancashire, England, L39 3NH. These terms cover use of our website and general information about engaging ClearScale. Contact hello@clearscalemarketing.co.uk with questions. They do not replace your agreed proposal or service agreement.

Your proposal governs your services

The scope, deliverables, fees, VAT treatment, payment dates, advertising spend, responsibilities, start date, minimum term, cancellation notice and any refund arrangements must be set out in your agreed proposal or service agreement. That agreement takes priority for the services concerned. A discovery call or website enquiry does not by itself create a paid engagement. Additional work or changes to agreed budgets require agreement.

Information and results

Website content gives general information about our services. Case studies describe particular circumstances and do not promise that another business will obtain the same outcome. Calculator outputs are estimates based on their inputs and assumptions, not a quotation or guaranteed result. Performance depends on factors including the offer, market, competition, budget, seasonality and customer follow-up. Nothing here changes an express commitment in an agreed service contract.

Using the website

You may use the website for lawful purposes, learn about our services and contact us. You must not attempt unauthorised access, interfere with security or availability, introduce malicious code, impersonate another person or submit information you are not entitled to share. We may take proportionate steps to protect the service against misuse.

Client portal access

Use only the account and permissions provided to you. Keep credentials confidential and tell us promptly about suspected unauthorised access. Do not access another organisation’s information. Portal access, account administration and any restrictions also remain subject to your organisation’s service agreement. We may restrict access where reasonably necessary for security or to comply with law.

Content and intellectual property

Our website content and branding belong to ClearScale or the relevant rights holders. You may view the site and keep reasonable copies for your own internal evaluation. You must not republish or commercially exploit protected material without permission or another lawful basis. Client names, logos, screenshots and other third-party material remain the property of their respective owners. Ownership and licensing of commissioned deliverables are governed by the relevant service agreement.

Third-party services and links

We may link to or use booking, meeting and other third-party services. Their own terms and privacy notices apply to their services. We do not control their websites or guarantee their availability. This does not remove responsibilities that apply to us under law or your agreement.

Availability and responsibility

We aim to keep information useful and the website available, but it may need maintenance and can contain errors. Please contact us about an issue. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Your statutory rights are not affected. Liability relating to paid services is governed by the agreed service contract and applicable law.

Privacy

Our Privacy Policy explains how we handle personal information. Our Cookie Policy explains browser storage. Agreeing to these terms is not consent to optional tracking or marketing.

Changes and applicable law

We may update website terms prospectively by publishing a revised version. Website updates do not retrospectively change an agreed client contract. These website terms are governed by the law of England and Wales. Courts of England and Wales have jurisdiction, subject to any mandatory rights to bring proceedings elsewhere. Nothing restricts legal protections that apply to a consumer.
